Who we are
GembaOps ("we", "us", "our") is a sole-proprietor automation-consulting practice operated by Frank Papaleo, based in Long Island, New York, USA. You can reach us any time at frank@gembaops.com.
What we provide
This website, along with free resources and guides, contact and booking forms, and automation-consulting services. Some of what we offer is informational and free; paid work is delivered under a separate written agreement (see below).
Acceptable use
Use the site and services lawfully and in good faith. Please don't misuse them — that includes scraping or harvesting content, overloading or interfering with the site or its infrastructure, attempting to gain unauthorized access, or using anything here for unlawful purposes. We may limit or end access if the site is being abused.
Intellectual property
The content on this site — text, graphics, layout, logos, and the GembaOps name — is owned by GembaOps unless otherwise noted. Free resources and guides are provided for your own personal or business use; you're welcome to use them internally, but please don't resell or republish them as your own. Anything we build for you under a paid engagement is governed by that engagement's written agreement.
Third-party services & links
We use and link to third-party services to run this site and our work — including HubSpot (CRM and scheduling), Calendly (scheduling), Cloudflare (hosting, DNS, cookieless analytics), and Google / YouTube (email and video services). Those services are governed by their own terms and privacy policies, and we're not responsible for their content or practices. Following a link off our site is at your own discretion.
No warranty
The site and any free resources are provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose. We work hard to keep everything accurate and running, but we don't guarantee the site will be error-free, uninterrupted, or that the information will fit every situation.
Limitation of liability
To the fullest extent permitted by law, GembaOps will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site, the free resources, or the services. Nothing here limits liability that can't be limited under applicable law.
Consulting engagements
Paid consulting work is governed by a separate written agreement (a proposal, statement of work, or contract) between you and GembaOps — not by these site terms. Where the two ever conflict about the paid work, that written agreement controls.
Changes to these terms
We may update these terms from time to time. When we do, we'll change the "Last updated" date above. Continuing to use the site after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules.
